FirstPlay, LLC Terms of Use
By accessing or using our web sites at www.firstplaysports.com, www.fstatennis.com, or www.falconsportsacademy.com (together the “Site”) you (the “User”) signify that you have read, understand and agree to be bound by these Terms and Conditions (“Terms of Use” or “Agreement”), whether or not you are a registered member of FirstPlay, LLC (“FirstPlay”) on our Site. We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Use at any time without further notice. If we do this, we will post the changes to these Terms of Use on this page and will indicate at the top of this page the date these terms were last revised. Your continued use of the Service or the Site after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to abide by these or any future Terms of Use, do not use or access (or continue to use or access) the service or the Site. It is your responsibility to regularly check the Site to determine if there have been changes to these Terms of Use and to review such changes.
I agree that I am entering an agreement with FirstPlay, LLC DBA First Serve Tennis Academy, Falcon Sports Academy, and FirstPlay Sports to provide me with products or services and understand that FirstPlay, LLC, Jackrabbit Technologies, and Authorize.net are handling my secure transaction and are not in any way responsible or liable for the service provided to me by FirstPlay, LLC and that my credit card statement will detail payment transaction through FirstPLay, LLC.
Registration
In consideration of your use of the Site, you agree to (a) provide accurate, current and complete information about you as may be prompted by any registration forms on the Site (“Registration Data” or “Family Profile”); (b) maintain the security of your password and identification; (c) maintain and promptly update the Registration Data, and any other information you provide to FirstPlay to keep it accurate, current and complete; and (d) be fully responsible for all use of your account and for any actions that take place using your account.
Terms of Sale
Certain products and services are made available to you (“you” or “User”) by FirstPlay, LLC or its corporate affiliates (collectively, “us”, “we” or “the Company”). By purchasing any products or services you signify that you have read, understand and agree to be bound by the Terms of Sale in effect at the time of purchase (“Terms of Sale”). These Terms of Sale are subject to change without prior written notice at any time, in our sole discretion, and such changes shall apply to any purchases made after such changes are posted to the Site. Therefore, you should review these Terms of Sale prior to each purchase so you will understand the terms applicable to such transaction. If you do not agree to these Terms of Sale, do not make any purchases with FirstPlay.
Purchase Qualifications; Account Security
To make an online purchase with FirstPlay, you must be a registered User and comply with these Terms of Sale (including the Terms of Use). You acknowledge that you are responsible for maintaining the security of, and restricting access to, your account and password, and you agree to accept responsibility for all purchases and other activities that occur under your account. FirstPlay sells its online services and products only to those users who can legally make purchases with a credit card. FirstPlay reserves the right to refuse or cancel orders or terminate accounts, at any time in its sole discretion.
Payment Methods
We accept Visa, MasterCard, American Express and Discover credit cards and checks as forms of payment. By submitting an order through our Sites, you authorize FirstPlay or its designated payment processor, to charge the account you specify for the purchase amount. All payments are to be made in United States Dollars. When you provide your credit card number to us, you authorize us to store your credit card number and related payment information.
FirstPlay Refund & Cancellation Policy
FirstPlay, LLC has a no-refund cancellation policy (except in case of a medical situation) and does not pro-rate programs for missed camp days or classes. If you registered directly with FirstPlay and are unable to attend the clinic or camp that you registered for, in some cases you may apply your registration to a future program. In order to apply your registration to a future program, you must contact us at least 7 business days before the program begins at 888-335-3318. If you registered through another organization, please contact that organization directly about their refund policy.
Please Note: Classes can be canceled/combined by FirstPlay at any time due to enrollment.
Weather Policy
All outdoor sessions have 2 additional inclement weather make-up dates pre-scheduled. These sessions will be used in the case of cancellations. If you registered directly with FirstPlay and if the total time lost to inclement weather is greater than the time allocated for make-up dates then a pro-rated credit voucher may be issued and applied toward a future registration. Cash refunds WILL NOT be issued in the case of weather cancellations. If you registered through another organization, their weather policy will be used in lieu of FirstPlay’s policy listed below.
If weather is an issue, please check our website (www.firstplaysports.com) or call toll-free 1(888)335-3318 (option 2) 1 hour before the scheduled class time. The status of that day’s classes will be on the website or on a voice recording.
FirstPlay, LLC Waiver and Hold Harmless Agreement
I hereby agree to let my child participate in this activity. I provided written documentation to FirstPlay, LLC of all medical information needed for my child. I understand that there are certain risks of injury inherent in the practice and play of this sport and/or activity and other related activities incidental to my participation, and I am willing to assume these risks. I hereby certify that my child is fully capable of participating in the sport and/or activity. I further certify that my child is healthy and has no physical or mental disabilities or infirmities that would restrict full participation in this activity, except as included in writing with this registration. In addition to giving full consent for my child’s participation, I do hereby waive, release and hold harmless FirstPlay, LLC, DBA First Serve Tennis Academy and Falcon Sports Academy and FirstPlay Sports, its officers, coaches, sponsors, partners, supervisors and representatives for any injury that may be suffered by my child in the normal course of participation in the sport and the activities incidental thereto, whether the result of negligence or any other cause. I grant permission for my child to receive emergency medical treatment. I grant FirstPlay, LLC permission to use photos or video images of my child for promotional materials.
